These terms apply when you use our website or hire LokalBiz ("LokalBiz", "we") for marketing services. Your signed proposal or service agreement sets out the specifics; if it conflicts with these terms, the agreement wins.
01Our services
LokalBiz provides Google Ads management, Google Business Profile management, local SEO and Google Maps ranking work, and monthly reporting through LokalBiz Reports. The exact scope, deliverables and start date for your business are set out in your proposal or service agreement.
We may use trusted contractors to help deliver the work. We remain responsible for it.
02Your responsibilities and account access
To do our job, we need you to:
- grant us the access we ask for — typically manager access to Google Business Profile, access to Google Ads, and viewer access to Google Analytics and Search Console;
- give us accurate information about your business, hours, menu, services and offers, and tell us when it changes;
- make sure you have the right to use any photos, logos and content you send us;
- pay Google (and any other ad platform) directly for ad spend.
Your accounts stay in your name and under your ownership. You can remove our access at any time, but work that depends on it will stop.
03Fees
We charge a flat monthly management fee per service, as stated in your agreement. Fees are invoiced monthly in advance and due within 14 days unless your agreement says otherwise. Ad spend is not included in our fees and is billed to you by Google.
We'll give you at least 30 days' written notice before changing your fee. Late invoices may pause work until they're paid.
04Data and confidentiality
Your business data — performance numbers, customer reviews, pricing, strategy — is confidential. We use it only to deliver your services and never share it with other clients or third parties except the service providers described in our Privacy Policy.
Data that LokalBiz Reports reads from Google is handled under the Google API Services User Data Policy, including its Limited Use requirements. Reports we create for you are yours to keep and share.
We may describe the type of results we achieve in anonymised form. We'll only name your business or quote you with your written permission.
05No guaranteed rankings
Google decides rankings, ad placement and what appears on Maps — not us. We can't guarantee any specific position, number of calls, or result.
What we do promise: to follow Google's guidelines, to do the work set out in your agreement, and to report honestly on what's happening, including when something isn't working. Anyone who guarantees a #1 ranking on Google isn't being straight with you.
06Termination
After an initial 3-month term, services continue month to month. Either of us can end them with 30 days' written notice. We may end services sooner if invoices go unpaid for more than 30 days or if continuing would break the law or a platform's policies.
When services end, we'll hand over any campaign settings, reports and assets we created for you, remove our access to your accounts, and delete your data as described in our Privacy Policy.
07Liability
We work carefully, but we aren't responsible for changes, outages or decisions made by Google or other platforms, including account suspensions, algorithm updates or policy changes.
To the extent the law allows, our total liability to you for any claim is limited to the fees you paid us in the 3 months before the claim, and neither of us is liable for indirect or consequential losses such as lost profits.
08Governing law
These terms are governed by the laws of the state named in your service agreement, without regard to its conflict-of-law rules. Before going to court, we both agree to try to resolve any dispute in good faith by talking first.
